

Southwell PAT Testing - Terms and Conditions for Portable Appliance Testing (PAT)

1. Definitions and Interpretation
1.1. In these Terms:

"Customer" means the individual, business, or organisation purchasing the Services.

"Equipment" means the portable electrical appliances to be tested by us.

"Services" means the portable appliance testing, visual inspection, and certification.
2. Scope of Service
2.1. We will carry out Portable Appliance Testing (PAT) on your electrical equipment to assist you in complying with the Electricity at Work Regulations 1989.
2.2. Our service includes a formal visual inspection, electrical testing (where appropriate), applying safety labels (pass/fail), and issuing a digital PAT certificate/report.
2.3. Testing is conducted to the standard laid out in the IET Code of Practice for In-Service Inspection and Testing of Electrical Equipment.
3. Customer Responsibilities and Access
3.1. Access: The Customer must provide a safe, unobstructed working environment and ensure all Equipment is accessible for the agreed testing times.
3.2. IT and Data: You must protect, save, or back up critical information or data before we commence testing. We are not responsible for any data loss, and we will not reboot or start up IT equipment.
3.3. Critical Equipment: Systems such as fire servers, mainframes, or telecom systems will only be inspected and tested if you provide express permission. If these cannot be shut down, we will only perform a formal visual inspection.
3.4. Failed Equipment: Items that fail safety checks will be labelled as "Failed". You are responsible for removing these from service and ensuring they are not used until repaired or replaced.
4. Fees and Payment
4.1. Prices are outlined in our Quotation. Quotes are valid for 30 days.
4.2. Payment Terms: Invoices must be paid in full within 14 days of the invoice date, unless otherwise agreed in writing.
4.3. Certification Release: We reserve the right to withhold certification, reports, and compliance stickers until we have received cleared payment in full.
4.4. Late Payments: We reserve the right to charge statutory interest and compensation on overdue invoices under the Late Payment of Commercial Debts (Interest) Act 1998.
5. Limitation of Liability
5.1. Our liability for losses caused by our negligence or breach of contract is limited to the total value of the Quotation for the Services provided.
5.2. We are not liable for any pre-existing faults discovered during the testing process or for any damage caused to Equipment due to pre-existing structural, wiring, or material defects.
5.3. We do not accept liability for business interruption or lost profits resulting directly or indirectly from our Services.
6. Cancellation and Rescheduling
6.1. If you need to cancel or reschedule a booking, you must provide us with at least 48 hours' notice.
6.2. Cancellations made with less than 48 hours' notice may be subject to a cancellation fee of up to 50% of the total quoted price.
7. Governing Law
7.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English and Welsh courts.
